Bosworth attorney: Appeal to SD Supreme Court coming

Here we go again! From AP/Brookings Radio News:

An attorney for a former South Dakota U.S. Senate candidate who has been convicted of felony election law violations says they plan to appeal to the state Supreme Court. Bob Van Norman, an attorney for Sioux Falls physician Annette Bosworth, said Thursday they plan to appeal after her planned July sentencing.

  1. She has nothing to lose by appealing her case, does she? As for the carnival ride, we could all probably help with that by focusing on other matters. How many Boz stories do we really need to read anyway?

    1. Nothing to lose? Off the top of my pointed head, I see freedom, family and a medical license. If she were to just say that she messed up, accepts her punishment and will move forward to be a better citizen, the judge may let her off easy. Then she could keep her freedom, family and provide the medical service she says she’s dedicated to. Or she thumbs her nose at the whole legal system, including the prosecution, judge and jury of her peers and appeals this verdict. Then she does her Boz of Arc mass mail fund raising appeal and maybe a Harley raffle. I’m sure the Attorney General’s sentencing recommendation and Judge Brown’s thoughts will all be influenced by what she does now. Some honest and sincere remorse could go a long way in the next 30 days. If she’s holding out for Gov. Howie to grant her clemency and give her a full pardon, she’s got a long wait ahead of her.

        1. As of today, she’s not in prison, she supports her kids and husband and her clinic is open for business.

          1. Point taken, but isn’t that partially because she’s been fighting her case in court? Now that her sentence is pending, what reason does she have to believe the court will cut her any slack? Just trying to see it from her attorney’s perspective.

          1. I think it is just forgetful. As we age, memory is the second thing that goes. I cannot remember what the first thing is.

  2. Does she keep her medical license pending appeal or how does that process work? Doctors? lawyers? can someone explain?

  3. According to the article in the above link, a felony conviction does NOT result in an “automatic ” loss of her medical license.

  4. Extending the drama just makes her narrative more interesting, gives her attention, and lets her raise more money.

    1. Until a judge says to her something along the lines of “I know you claim you were acting under advice of counsel, but if a lawyer told you to jump off a cliff, would you do it?” I don’t think she’s going to get it. Even then she might not get it. And her supporters are so deranged they are never going to get it.
