So much for the state constitution.

In a press release this AM, Kathy Tyler is trying to politicize the state constitution this morning by claiming it’s biased against Democrats because of EB-5., despite the federal program being younger by about 140-150 years than the state’s founding document.

ARE REPUBLICANS PUNISHING DEMOCRATS FOR EB-5 INQUIRY?

PIERRE, SD — Republican leaders have fired a legislative secretary in the State House of Representatives, leaving Democrats wondering whether the incident is related to the EB-5 inquiry.

Republican and Democrat leaders are allowed to employ staff secretaries during the legislative session. Both Republicans and Democrats have Caucus secretaries. Because of their minority status the Democrats only have two — a secretary to the House Minority Leader and a secretary to the Senate Minority Leader.

House Minority Leader Spencer Hawley interviewed applicants and selected former legislator Kathy Tyler as the House secretary, but she received notice that she was terminated on Friday (Jan. 16). Republican leaders pointed to a constitutional provision (Article 3, Sec. 12) that says legislators may not have an interest in a state contract while in office or for a year after leaving office. The provision has proved controversial in the past because of its vagueness.

Controversial? Apparently Tyler doesn’t know her state constitution. Or bothered to look at the issue other than having her written hissy fit.

Because last I checked, it’s been far more Republicans who have been stung by this. Such as in the last time this came up in Pitts v. Larson.

[¶ 5.] On February 9, 2001, the Attorney General of South Dakota learned from the media that Pitts was a state employee. The Attorney General advised Pitts that her employment with SDSU CES and her position as a member of the House of Representatives presented a conflict of interest. Pitts, her attorney and the Attorney General’s Office entered into discussions on the matter. At the conclusion of the discussions, Pitts was advised that if she continued her employment with the State after July 1, 2001, the date on which the General Appropriation Bill was to take effect, her employment contract would be voided and she would not receive any compensation for her services.

It was pretty cut and dried the last time the issue came up. If Kathy Tyler had bothered to look at the history of this constitutional provision she would have quickly found that it was neither controversial nor should it have come as a surprise.

For something she should have clearly realized, pouting about it in the manner she is just diminishes Tyler’s prior service and makes her look silly.

And that’s not shocking given her tenure.

  4. You know, let’s be honest for a minute. Our state relies upon a herd mentality, and everything is okay as long as you stay with the group. Those of us in the herd trust those people at the vanguard to keep us going in the right direction, and if they make a mistake…..so what, you forgive’m. EB-5 mistake…okay, but you forgive’m. Rounds is a heck of a good guy, and you gotta forgive’m. You cannot punish a good patriot like Rounds by not letting him be U.S. Senator. Unfortunately, Ms. Tyler didn’t know the rules, or she chose to ignore ’em. Out of the herd, bellerin, maki’n a big old fit….what’ya expect gonna happen? Wham! Good night! Our State is filled with good American patriots ( Krebs, Jackley, Mr. D., little Matt, Andy G.) and we do not need whackos making their life more challenging. God Bless the U.S.A.

    1. are you serious about the herd thing? i doubt it, that was pretty sarcastic. thanks. regarding herds, those ‘riding herd’ in political ads last year were doing anything but ‘forgiving’ mike rounds, and for a ‘herd’ the voters who chose rounds seemed to be thinking their way past the wall of total bullcrap very well. on the other hand, we have the secret covens of the democrats, sharing their half-baked double math on alleged state budget atrocities, and the evil republican conspiracies which others only see as a responsible party doing the best with the limited-goverment resources at their disposal. if i had to award a prize for best herd mentality, it wouldn’t go to the republicans.

    2. anon is right South Dakota doesn’t exactly have a lot trailblazers or people looking to rock the boat. For a society this is a bad thing because it creates complacency and like the military tells its members in force protection briefings complacency kills and it may have literally kill in regards to EB-5

    3. and again i disagree that anon is right, on the merits of the argument put forth by anon, which was a pile of sarcastically delivered faux support for the position that an alleged republican “herd” mentality is a good thing, and the obvious takeaway from the statement was “i’m pretending to be a republican who understand how we love herd mentality.” ha. ha. now your posting in support of anon is interesting because you’re making your own point about herd mentality that bears no relationship to any of the points anon raised, except to imply “anon’s post is accurate because even he, a dumb republican, knows he’s in a herd mentality situation.” and again, i disagree.

  5. Anon, you don’t know Tyler. If you want to know what makes her tick, spend some time in Milbank and talk to people who know her. . What animates Tyler is her arrogant belief that she is always right, no matter what. She wants you to believe she is the most important person in any conversation or in any room . No matter the subject, she has researched it and is the self-claimed expert at it – EB5 is just the most recent example. There are many more. She’s had her time in Pierre. People now see her for who she is. She single-handedly turned Milbank into the laughing-stock community of South Dakota. Most people in the community now recognize her shortcomings, and it’s the reason so many rejected her at election-time. The feeling in the community toward her now is mostly either pity or indifference.

      The same can also be said about quite a few Republicans: Noem, Johnny Tune, good ol’ boy Rounds, Jackley, etc etc etc. I could go on and on but I would be typing all night.

  6. It’s kinda odd that Rep. Hawley or some other Dem. in leadership didn’t know the rules and the Constitution. But, maybe that’s why they’re Democrats.

    1. It’s kind of odd that during the first week of legislation, Kathy is what was on the minds of Republicans. (Also, Republicans have been doing the same thing-that part was just conveniently left out by the blogger)

  7. Interestingly, Tyler’s recent attack on tech schools assures her irrelevance at the ballot box in the future. Claims that canning her have something to do with dimming her very dim political bulb, would be like Howard Stassen bitching about his ballot placement (ok, modern and closer history, Ron Volesky complaining).

  8. A lot of people think Ms. Tyler was one of the dimmest bulbs in the legislatures. Ms. Wismer picked her as an attack dog. It led to the whuppin at the polls bigger than any other whuppin ever before. Ms. Tyler should not have kites tied to her tails.

  9. What kind of blog did I stumble upon?? Where was the hissy fit in a completely respectful press release? Do you even actually know if Kathy wrote it? Geez. Fact check buddy.

    And good editing by leaving out most of the press release, you know-that told the story about how Republicans have been doing the same thing for years.
