In recent writings, some of Annette Bosworth’s supporters are calling the potential sentence that Bosworth is facing unusually harsh. But, in a review of a similar case involving the mishandling of petitions, those defendants faced over 20 years in prison, but that’s not what they got.

The South Bend Tribune, which inspired the case against Morgan, Blythe and two other defendants with a 2012 investigation of election fraud in the 2nd Congressional District, says Morgan is looking at a possible 22 years in prison, while Blythe could face 75 years. The two co-defendants, who pleaded guilty to felony counts, are facing 11 and 14 years.

Read that here.  Just as in the Bosworth case, people were facing over 20 years in a state penitentiary. But when the sentence was read, realistically, things were taken in proportion.

In court, former longtime St. Joseph County Democratic Chairman Butch Morgan, Jr. was sentenced to one year behind bars, and is expected to serve half that, as well as Community Corrections and probation. Former St. Joseph County Board of Elections worker and Democratic volunteer Dustin Blythe received a sentence of one year in Community Corrections and probation, which means no jail time.

In April, a jury convicted Morgan and Blythe on numerous felony conspiracy counts to commit petition fraud and felony forgery counts.

Former St. Joseph County Board of Voter Registration Democratic board member Pam Brunette and Board of Voter Registration worker Beverly Shelton previously pleaded guilty and testified for prosecutors against Morgan and Blythe. They both received two years of probation.

“When you do something like this, we are going to find out and you’re going to be held accountable,” declared Levco. He called the sentences “appropriate.”

Others disagreed.

“We would like to have seen more jail time for Morgan … but it was more than we were expecting,” said St. Joseph County Republican Party Executive Director Jake Teshka. He thinks the three other defendants “got off easy.”

(Given she’s readily admitted the behavior she’s charged with – attesting she witnessed signatures she didn’t witness) If convicted, what do you think her sentence will be?

I’m guessing a year in state prison, and as in this case, part, but not all, will be suspended. Your thoughts?

  1. Prison time would punish her children more than anyone else. I hope she gets probation, for their sake.

  2. 5 years in prison seems reasonable. She will probably not be a physician anymore but with good behavior she could be a trustee in the prison medical clinic.

  3. I think it’s really sad that people like Rev. Steve Hickey went after this poor woman at the behest of radical SD liberals, when compassion and offers to help her out of this fog would have been more beneficial. What a poor example of a Christian condemning another wayward Christian.

    Yes, in the end, she should be placed on probation , supervised closely, and ordered to seek the counseling needed to lift the fog of false martyrdom.

      As I clearly stated when I “went after Boz” I did so for these two reasons: 1) it was frustrating to me that the most overtly Christian candidate was stunningly unscrupulous in ways far beyond her nominating petition mishaps 2) no one else was doing anything (probably because it would look like it was coming from another Senate candidate) and I thought it was high time the GOP clean it’s own house.

      Good for Marty for tossing every conceivable charge at her in what she could be charged with because we all know there were many and far greater scams that weren’t prosecutable. She is getting off easy.

      That she wan ultimately able to bilk $2.1 million for unsuspecting people for a no-chance small state senate race is sickening to me. Does her husband have a job yet? Has he paid his $3000 fine to the Secretary of State yet for his late campaign finance report?

  4. I’d be surprised if she got more than 30 days. What she did is really not much worse than what schlekaway and crew did and they got a hand slap. Yes I know they pled to misdemeanors.

  6. The 2013 criminal justice reform bill practically guarantees that she won’t see the inside of the penitentiary because her crimes are low level felonies and she’s not a risk to the public. If she smartens up and takes a deal to plead guilty to one or two counts, she probably gets probation and no jail time. If she goes to trial and gets convicted on all twelve counts, she might see a month in the county jail.

  8. Opposition to the death penalty is not an act of compassion to a rapist or murderer. It is an act of mercy. Two very distinct and different acts.

    Compassion is entering into the suffering of the other as one can spiritually emotionally or physically.

    Mercy is giving someone something they don’t deserve.

    1. Giving someone, who deserves the punishment of death, absolution of their crimes (without confession & repentance) is not mercy. It is the miscarriage of justice brought on by vane, arrogant, hypocrites, who have no faith in God’s word.

  9. Justice is defined in the dictionary as “administering of deserved punishment or reward.” In other words, to give a person what they are due.

    Mercy is defined in the dictionary as “the discretionary power to pardon someone or to mitigate punishment otherwise deserved.” In other words, to choose not to give another what they are due.

    If a person is deemed to deserve capital punishment and are executed, they received Justice. If a person is deemed to deserve capital punishment and are given life in prison, they have received Mercy.

    Its the same thing if they are deemed to deserve 30 days in jail. If they get 30 days in jail it is Justice. If they get probation, it is Mercy.

    Confession and repentance are often prerequisites to getting forgiveness but are unrelated to mercy and justice because the administration of justice and mercy is in the exclusive hands of the legitimate authority (Judge/jury). Confessing and repenting may still result in the administration of Justice or Mercy. Not confessing and repenting may still result in the administration of Justice or Mercy.

    Absolution is defined as “a freeing from blame or guilt; release from consequences, obligations, or penalties.” First, I don’t know of anyone advocating that murder/rape etc. should have no consequences or penalties so that comment is just off and irrelevant.

    With regard to faith in God’s word, I’m really confused. Christ’s greatest “sermon” said: “Blessed are the merciful, for they shall receive mercy.” Not only didn’t he say we should aspire to Justice but called us to aspire to not “an eye for an eye and a tooth for a tooth (Justice) but to “turn our other cheek” (Mercy).

    Aspiring for the administration of Justice isn’t bad or evil but good. But, finding it in ourselves (with God’s Grace) to give Mercy is a higher call. Reading the whole of Mathew 5-7 speaks much about mercy, forgiveness, giving up anger, and it is not to to only extend it to those we love (even the tax collectors do that) but to those who are enemies, even evil.
