Statement on Finalization of Zylstra Kaiser Lawsuit

PIERRE, S.D. – The State of South Dakota confirms today that the State of South Dakota has finalized the Laura Zylstra Kaiser lawsuit. This case and settlement was handled by the Governor’s Office of Risk Management and the State’s insurance company.

The Director of the Division of Criminal Investigation, Bryan Gortmaker, first received the compromise settlement agreement and release in full of all claims on Friday, May 18, 2018. The paperwork was signed and finalized by the Governor’s Office of Risk Management on Monday, May 21, 2018.

Based upon these dates, this settlement was not delayed. The language of the settlement agreement states the following: The payment will be made by delivering the checks to Kaiser’s attorneys so that the checks are in their hands no sooner than May 21, 2018, but in no event later than June 8, 2018.

    1. It is sad to see Noem use a victim for her own political gain. She will do anything to win. I wouldn’t be surprised if she puts out a commercial featuring Kaiser. Shame

  4. Reading between the lines here:
    The money was supposed to be paid in April.
    But Gortmaker first received the settlement agreement and release of claims on May 18, which suggests that before she could get the money, another set of papers was sent to her for her signature. Which, of course, her lawyers had to read over first.

    Whether or not the additional paperwork was necessary or just a stalling tactic is the issue here. Anybody who has ever gotten the runaround from an insurance company has experienced this. The pay out is coming, but first we need more information, and you have to sign this. And then we need that. And there is something we need from another party before we can cut the check. Oh, and you still haven’t given us the bank information, because we aren’t going to mail you a check, we want to deposit the check directly. Insurance companies can keep this going for months. It’s what they do.

  5. This isn’t an insurance company it’s the State. You and me as taxpayers footing the bill for Jackley’s DCI problem.
