South Dakota Supreme Court Upholds Bosworth Felony Convictions and Sentence For Election Law Violations

PIERRE, S.D. – Attorney General Marty Jackley announced today that the South Dakota Supreme Court has affirmed the felony convictions and sentence of Annette Bosworth for filing false petitions in her 2014 U.S. Senate Primary race.

“Today’s decision upholds and protects the integrity of our institutions and elections in South Dakota. The decision affirms the hard work and deliberations of our citizen jurors in this case,” said Jackley.

Bosworth raised three issues challenging her convictions including the claim that her petition sheets were not false instruments.

In May 2015, Bosworth was convicted on 12 felony election law violations. She was sentenced to 2 years for each of the 6 convictions for filing false or forged documents and 2 years for each of the 6 convictions for perjury. All sentences were suspended, with 3 years of probation. The court vacated charges on six counts of perjury, finding that submission of petition forms is not “process” within the meaning of the perjury statute. Based on the affirmance of the convictions and sentence for the six felony false document charges, there will be no further court proceedings on either the perjury charges or the sentence.

  1. So will AG Jackley also prosecute Sec. Krebs, for what appears to be her violations and failure to uphold and protect the integrity of our institutions and elections in South Dakota? The Secretary of the office most responsible to do just that. The “sorry I made a mistake” plea didn’t seem to work for Dr. Bosworth, not sure why it should work in this case either.

  2. Nice try at spin, Jason, but this one’s going to likely come back to haunt him. I think most of the state recognized the overkill on this case…. How do you say, witch hunt….

    1. Speaking of Roundborg numerous sightings of Jason. Driving aimlessly around SoDak pretending to be someone he’s not. Numerous foil bits left behind where he’s been.

  3. This is a great example of the cronyism in Pierre that needs to end. Dr. Bos gets the book thrown at her while Secretary Krebs gets a pass. Shame on Marty Jackley.

  4. AG Jackley went too far, the Supreme Court overturning his overzealous verdict should make voters question his motivation and judgment.

    Flag Stealer –$1500 fine
    EB 5–2 years probation and $2000 fine
    Bosworth–6 felonies but 6 overturned by Supreme Court

    Now on Federal side I give more credit fighting Obamacare and Immigration Executive order from Obama.

    1. Tara will Annette and Chad be running for office again? She could use this ruling to get campaign donations outside of South Dakota again.

  6. I don’t think she can until the other 6 felonies are removed. Her campaign team did a brilliant job with the fundraising. I don’t think she raised as much out of state money as the other candidates in various races. Maybe the 2018 candidates should sign a pledge….NO OUT OF STATE MONEY. How many people do you think will sign the pledge?
