Jackley reiterates that non-tribal pot users at Flandreau pot lounge will be arrested

From Today’s KCCR – AG Marty Jackley reminds residents that he’s not going to turn a blind eye to the proposed Flandreau pot lounge, and that any non-tribal members using pot there will be arrested and subject to prosecution:

Regardless, the tribe has begun growing marijuana on the reservation and is looking at a New Years Eve opening for their resort. However, Jackley says, anyone breaking state law will be arrested.

Jackley says tribal members would be within their right to use marijuana on their own tribal lands, however non-Indians would not.

 Should there be probable cause; Jackley says state law enforcement officials have the right to enter the reservation and arrest individuals who are committing a crime. Search warrants would be needed.

  1. OK, I have to say it. You are going to arrest caucasians but not Native Americans? Maybe there is precedent for this but it still doesn’t seem right.

    1. Jimmy – it may seem weird, but that’s how it is. I believe it comes from some of the cross jurisdictional issues set up by treaty.

  2. This will be interesting, I wonder if it is just the specific Sioux tribe members, or if your a member of any tribe.
    Meaning…if a member of the Crow tribe were to travel to Flandreau to enjoy the New Years Eve party with the Sioux Tribe would they be arrested?

    Also if a local Pot Head from Sioux Falls were to buy a oz from the Sioux Tribe, and he is not a Sioux tribe member, then would the tribe be charged with distribution of illegal substance?

    Would law enforcement require people to carry their tribe membership card? If they didn’t show proof instantly would they then be arrested and charges dropped after proof?
    Will the tribe require proof of membership of the tribe before selling?

    Just wondering how this all would work…as said before…this will be interesting.

    1. OK Mike. How about this. Adopt the same laws as Colorado and use the tax proceeds to increase educator’s pay. South Dakota ranks at the very bottom of teacher’s pay and this would be one way to get this problem solved.

      1. ok Francis. How about this. Look at how those who posted and replied on SDAP’s facebook page have challenges completing sentences with punctuation. Then look at their profiles and where they work if they work at all. Their obsession with weed seems to have hampered their chances for upward mobility. It’s very unfortunate that their opportunities will be very limited unless they make some changes in their lives.

  5. Video lottery, how many lives ruined by state sponsored gambling? How many deaths related to alcohol by way of highway fatalities? Just what harm by those who want to take a toke now and then?

  6. Maybe a little pot would help me get through tonight’s Democrat debate. But, being the goody two-shoes that I am, I will be settling for a beer or two instead. (I predict O’Malley will benefit the most.)
