Bollen to be charged with 5 counts of 44-1-12. Disposing of security.

Given how vague the Attorney General’s press release is on charging Joop Bollen , I went back and asked the AG’s office what charges were being filed. They replied “I can give you the file number – 16-383” and noted “More detailed release tomorrow after initial appearance…”

In having an attorney friend of mine look it up, it’s my understanding that the felony criminal charges filed in this case consist of 5 counts of Class 6 felonies for violating 44-1-12, which reads as follows:

44-1-12.   Destruction, disposal, or removal of personal property subject to security interest as felony. Any mortgagor or grantor of a security interest or other lien of personal property who, while the lien of his mortgage, conditional sales agreement, or security agreement remains in force and unsatisfied, willfully destroys, conceals, sells, or in any manner disposes of or materially injures any part of the property covered by such mortgage, conditional sales agreement, or security agreement without the written consent of the holder of such mortgage, conditional sales agreement, or security agreement, or who willfully abandons the property covered by such mortgage, conditional sales agreement, or security agreement without first giving written notice to such secured party of his intention to abandon such property, or who removes any part of the property covered by such mortgage, conditional sales agreement, or security agreement from the county in which such mortgage, conditional sales agreement, or security agreement is filed except temporarily in accordance with the usual and customary use of the same or similar kinds of property while the lien of his mortgage, conditional sales agreement, or security agreement remains in force and unsatisfied without the written consent of the holder of such mortgage, conditional sales agreement, or security agreement, is guilty of a Class 6 felony.

This is not unlike what’s taking place in the matter of the Gear-Up case, where what’s currently being prosecuted for two of the defendants are similar low level charges involving falsification of evidence.

Not the most significant of charges, but sometimes you have to play the hand you’re dealt.

PIERRE, S.D.- Attorney General Marty Jackley announced today that felony criminal charges have been filed in relation to EB5 and SDRC Inc.

Joop Bollen voluntarily turned himself in on an arrest warrant. He has cooperated and has been released by the Court on bond conditions. Bollen is presumed innocent until such time as proven guilty.

Attorney General Jackley will be handling the initial appearance, which is scheduled for Friday, April 1, 2016 at 9:30 a.m. at the Brown County Courthouse and will be available for comment following the hearing.

PIERRE, S.D.- Because the Attorney General handled the criminal trial for the capital murder cases involving the death of Correctional Officer Ronald Johnson, the Attorney General’s Office is neither handling nor involved in the civil proceedings of Mrs. Lynette Johnson or the Department of Corrections, including the issue of court costs.

Secretary of State recognizes New Political Party

Pierre, SD – Today, Secretary of State Shantel Krebs announced that a new recognized political party has been formed. The Constitution Party submitted 7,655 valid signatures. The required number of signatures that must be submitted to form a new political party are 6,936 (2.5% of total vote for Governor in 2014: 277,403) (SDCL 12-5-1)

The Secretary of State’s office will be updating sdsos.gov in the next couple of days to reflect the new political party formation.

2 more primaries popped up last night.

Since I looked last, two more Senate Primaries have popped up.

In District 5, recent SDWC advertiser Neal Tapio filed petitions to run against Roger Solum in the Watertown Area for State Senate.

Here in my home district in Brookings, someone I’ve never heard of, Doug Post, has filed to take on Larry Tidemann for District 7 State Senate.

Just wanted to share this with you. The Students for Reproductive Rights group on campus is having a “Hanger Display” today in the Muenster University Center at USD.  Classy Liberals never take a day off.

My main observation, other than a disinterested person manning the table, is that noticing the display, I don’t think they attempted abortions with the plastic ones back in the pre Roe v Wade days.

The wooden and plastic ones are so you don’t have a crease in your clothes.

So how many of these Dem Candidates are placeholders?

I’m looking at the lists of candidates, and with some of the Democrats, I’m noticing some are awfully familiar. I had mentioned Alanna Silvis in Watertown, and I was noticing Holly Boltjes in Hartford… and It got me wondering “how many of the Democrat Candidates are placeholders?”

Both Silvis and Boltjes participated in the Dem’s placeholder shuffle before… so, why would we believe either are running for real this time? Silvis performed the function last election, and Boltjes has done it two or 3 times.  In fact, Boltjes was originally a placeholder, and had awful Congressional candidate Paula Hawks dropped in her spot one election, and went on to win.

So, why would this election be any different?

Anyone in the field have any specific reports about the placeholder status of any of the Dems running this year?  Leave a note under the comment section, and let us know.

Alanna’s back in the race! You remember Alanna, don’t you?

Alanna’s back in the race!!  Do you remember Alanna?  Of course you do! Democrat placeholder Alanna Silvis!   She gave us a reason for a great post a couple of years ago, and according to the Secretary of State, she’s placeholding again for District 5 House.

You don’t remember Alanna? Hm. Short memory. Well, here’s an excerpt from my old 2014 post:

 

So, I think it’s safe to say that Silvis is not unaware of what goes on in elections, having almost run before, and I believe her mother is also the Codington County Democratic Chairman.  However, when it comes to Silvis’ social media, before she decided to run for office, you would think that she probably would have cleaned it up a bit:

These aren’t the only examples, just some of the more notable ones. It’s pretty bad when there are posts that are so profane that they would need to be redacted just to put them out on a postcard.
