Gov. Rhoden Signs Bill to Protect Property Rights
PIERRE, S.D. – Today, Governor Larry Rhoden signed HB 1052, which protects the property rights of South Dakota landowners by prohibiting eminent domain for a pipeline that carries carbon oxide. Governor Rhoden outlined his reasons for signing the bill in a letter to the legislature and people of South Dakota. You can find the letter here.
“HB 1052 does not kill the proposed project. Rather than viewing this legislation as an obstacle to the proposed project,” wrote Governor Larry Rhoden. “I encourage Summit and others to view it as an opportunity for a needed reset Voluntary easements for this proposed project will still be able to move forward… In fact, without the threat of eminent domain, the opportunity might finally be available for trust to be rebuilt and for more productive conversations to occur between Summit and South Dakota landowners.”
“I am no stranger to discussions about eminent domain and property rights. I’ve fought for private property rights in this Capitol for over 20 years,” continued Governor Larry Rhoden. “We are keeping South Dakota Open for Opportunity, and HB 1052 will not change that. The ethanol industry will remain a crucial part of our state’s economy and a key asset as we implement an all-of-the-above energy approach to restore American energy dominance.”
Governor Rhoden has signed 58 bills into law this legislative session.

Dakota First Action is not stopping on just the pipeline debate.
Doeden will look to oust in our area Senator Michael Rohl from District 1 and he voted in favor of HB1052. In fact Rohl and Representative Kadyn Wittman were awarded the Distinguished Service Award by the South Dakota Farmers Union Wednesday. SDFU is not exactly a conservative outlet but always were in support of landowner’s right unlike the South Dakota Farm Bureau that was on record opposing this bill.

Phenomenal! A great day for property rights in South Dakota. As the governor said, if the pipeline has merit AND buy-in from the landowners, it can proceed.
Yeah I bet our corn growers and ethanol producers are dancing with joy. This will be damaging to our state. We lose credibility by singling out carbon and not trying to do actual eminent domain law reform. Thank you to senator mehlaff for trying to be bring honest, reasonable discussion to the table about the issue. This had nothing to do with eminent domain and everything to do with manufactured hate for carbon. I’m quite disappointed in the governor, but he likely felt the need to feed the angriest voters. It also entrenches the extremist and obstructionist mindset that was elected this session. Good luck restoring order and common sense to the legislature now. If you think this session has been bad, just wait until next year.
You are 100% correct!! It will be a miracle if the Ethanol plants are even open in 5 years…we’ll be back to $2 corn. Meanwhile the states who see what this project will do for them will be making money. Senator Mehlaff ignored the Oposition bullies & tried to do the right thing. SD is NOT open for business or progress. We cower to bullies who lie to get what they want! The bully wasn’t Summit Carbon…it was the radical group against the project who attacked anyone for it…including family & neighbors.
Now the farmers will be expected to fund SD financial deficit after being kicked in the teeth. Summit should sue the state for they have done to them.
The radical group is for certain the adult bullies who attack anyone who opposes them with fear tactics but Summit did some things wrong in the process also.
In the end, the votes were strongly in favor of the bill in both chambers. The governor ‘almost’ had no choice but did leave the door open. If there is a next time, maybe Summit will alter their approach to landowners.
This was a failure by the governor. Regardless of what you think about carbon capture and the pipeline, signing this bill emboldens the extremists. Vetoeing the bill would have forced another discussion and allowed the moderates to gain some footing and find their voice. The veto may have been overidden but at least we could give the appearance that we aren’t anti business. Chlidren are running the show at the state right now and Rhoden has now encouraged them. I’ve said how he handles this session will determine my vote for governor. He’s fueling a fire that will take years to put out now.

Very rare to override a veto with the vote counts the way they were. No excuse for the Governor who was for carbon pipelines last year.
That’s quite the spin he put on it. “encourage summit to see it as an opportunity”. Not even if you stand on your head, squint your eyes and drop acid could you see it as an opportunity. Summit is now a common carrier that has been singled out from using the means granted to everyone else. The landowners will certainly see this as an opportunity. You need to cross my property to complete your project? That will be $1 million please, because you can’t do anything about it.

I 100% agree that Summit started way to strong & aggressively but they took step back regrouping & rerouting. If the oposition told the truth about what happened, it would be different. RL21 as an example…even so of the Senators thought it was a Eminent Domain bill when it wasn’t. Everyone was lied too! Passing this bill was simply cowering to the bigger bullies at the expense of SD Farmers
Minnesota killed Pipestone 2 by refusing to grant permits for the electric transmission line that would also have allowed tons more wind energy development in SD. All this bill does is strengthen the Leftists to the East
Between this and the year-round E15 delay, Governor Rhoden is proving himself no friend of the SD corn farmer
I like this. I don’t recall seeing a measure so poorly explained by just about everyone. The pro-pipeline people couldn’t justify the loss of private property rights, and the opponents couldn’t get of the shadow of eminent domain they incorrectly cast upon themselves. The biggest problem has been messaging. This eliminates the biggest problem all around, and maybe, just maybe we can have an informed discussion. Good job, Governor.
What discussion is there to be had? The discussion will be with summit and the feds to allow them to use federal eminent domain as this is a multi-state project. I hope they get it granted to them and everyone can learn a real lesson about how things work.
This issue is far from a slam dunk in federal courts.
