COURT HALTS BIDEN ADMINISTRATION’S HEALTHCARE WORKER VACCINE MANDATE FOLLOWING LAWSUIT FROM 10 STATE ATTORNEYS GENERAL COALITION
PIERRE, S.D. – South Dakota Attorney General Jason Ravnsborg announced today that a Missouri federal court granted South Dakota’s request for an injunction on the Biden Administration’s vaccine mandate for healthcare workers. Earlier this month, South Dakota joined a coalition of ten states challenging the mandate. In addition to South Dakota, the coalition includes Missouri, Nebraska, Arkansas, Kansas, Iowa, Wyoming, Alaska, North Dakota, and New Hampshire.
In the ruling U.S. District Judge Matthew Schelp writes that “the court cannot, in good faith, allow CMS to enact an unprecedented mandate that lacks a ‘rational connection between the facts found and the choice made.’”
“This is a huge victory for healthcare workers in South Dakota, and especially for our rural hospitals and health care professionals who provide such crucial care to so many of our residents,” said Ravnsborg. “This ruling is a big win against this unprecedented federal overreach.”
The full ruling can be read here.

Good job Mr. Attorney General! appreciate your hard work on this important subject!
Agreed, keep up the hard work AG Ravnsborg. We are lucky to have you as our AG!!
We’ve had a lot of nursing home deaths from Covid. Even while visitation was limited. Who do you suppose gave them the virus?
You know better.
“This is a huge victory for healthcare workers in South Dakota” Really?
I see eight more deaths were reported in South Dakota today. Just eight. But you would defend healthcare workers’ rights to spread Covid to staff and patients? This makes sense to you, Jason Ravnsborg?
Sure, you could argue that it’s the state’s responsibility to do these things vs. the federal government. But… they haven’t. They’d rather play politics than save lives. So they leave the federal government no choice but to act if they want to stop the virus.
If it gets to the US Supreme Court, I think it will be overturned. This pandemic is an emergency that obviously crosses state boundaries.
I would guess that recent deaths are about four-to-one Republican over Democrat in this area of the country. I suppose this makes sense to you too?
Every death, by any cause, is a 4:1 R to Dem ratio in SD.
Less than 2 to 1.
I believe this case is about Feds requiring the vaccination so it would not apply to companies i.e. Avera, Stanford requiring the vaccination
SD advocates company over worker rights.
Can someone please explain why you think that this vaccine is different from the ones that have been mandated by the state?
Elk, are you able to discern the difference between a state govt mandate and one coming from the federal govt?
Have I not been talking about both?
From SD Dept. of Health:
“Minimum immunization requirements for kindergarten through twelfth grade are defined as receiving at least:
Four or more doses of diphtheria, pertussis and tetanus containing vaccine, with at least one dose administered on or after age 4. Children 7 years or older needing the primary series only need three doses. Children receiving six doses before age 4 do not require any additional doses for kindergarten entry. The maximum a child should receive is six doses. If a child 7 years or older has an incomplete DTaP primary series, please contact the Department of Health for assistance.
Four or more doses of poliovirus vaccine, at least one dose on or after age 4. (Although not the recommended schedule – If a child has three doses of polio with the third dose administered on or after the age of 4 and at least 6 months after the second dose, no other doses are required.)
Two doses of a measles, mumps, and rubella vaccine (MMR or MMRV). The minimum age for the first dose is 12 months. Administer the second dose routinely at age 4 through 6 years. The second dose may be administered prior to age 4 provided at least 28 days have elapsed since the first dose.
Two doses of varicella vaccine (Varicella or MMRV). The minimum age for the first dose of varicella (chickenpox) vaccine is 12 months. History of disease is acceptable with parent/guardian signature. Administer the second dose routinely at age 4 through 6 years. The second dose may be administered prior to age 4 provided the minimum interval between the two doses is 3 months.”
So… what’s with the politicization of the Covid vaccine? As citizens, we don’t know a damn thing about how any of the other vaccines were developed but you’ve manufactured all of these excuses to avoid this particular one.
There is plenty of science about the covid vaccine. Do the research.
On average, individual citizens cannot possible know enough about any vaccine to make an intelligent decision about whether to refuse a vaccine mandate. State or federal. If we think we can allow 340 million people to individually decide, we are screwed. (Again, see all of the state mandates above.) Without vaccines, most countries would forbid travel by Americans.
Of course medical or religious exceptions may be necessary in a few instances. But we are now headed toward vaccine hesitancy for a large percentage of people. And it’s dangerous.
Freedom does not equal stupid.
But you are stupid.
Vamos Brandon I did do a lot of reading about the vaccine.
It will not make you magnetic and cause spoons to stick to your skin. It is not 99% graphene car polish. It does not cause infertility, make your genitals fall off, or your hair fall out. Two out of every 100,000 people develop blood clots after receiving the Johnson & Johnson or Astra-Zeneca vaccines, compared to 20,000 out of 100,000 people who get covid instead of the vaccine.
Unvaccinated people now make up less than 30% of the population but 90% of the hospitalized patients.
The vaccines work and are much safer to get than the disease. How much more research do you want?
You didn’t do the RIGHT research. Try http://www.trustmeimacoviddoctor2020.ru 🙂
Since Biden doesn’t enforce the southern border, doesnt test or require vaccination of these illegals, and then ships them across the country, I don’t believe in mandating american citizens. It’s all smoke and mirrors ans control.
Proud that our family, including all age eligible children, are vaccinated and boostered when appropriate. Hope the nonvaxxers are brave enough to die at home and not take up hospital intensive care space when they succumb to the Delta or the next one coming.
Proud to be a sheep.
I’m of two minds about this.
On one level – I want all health care workers vaccinated. I want everybody vaccinated. We have enough data to know that it’s safer to vaccinate than to run the risk of getting covid – especially if you are in an environment where you will be exposed and run the risk of exposing others. This is the smart, better, choice.
On another level – I really don’t want the executive branch of the federal government to be able to make rules like this via executive order. The Health Care worker and OSHA mandates strike me as Executive overreach. (The mandates for the Military and Federal contractors are a different story – the Executive branch does have the ability to set those rules. I may not like this being dictated by Executive Order, but it’s within the historic bounds of what can be done with an EO.) This is the kind of thing that should be voted on by congress.
Even if these ARE legal executive orders (this was just an injunction, not a final ruling) it SHOULD go to court to verify it’s legality.
