Anti-pipeline lawyer reprimanded by Iowa Supreme Court for South Dakota actions considered “deceptive”

Brian Jorde, an attorney who has represented landowners in South Dakota against Summit Carbon Solutions was recently sanctioned by the Iowa Supreme Court for filing “misleading or deceptive” information during utility commission reviews of permit applications.

According to South Dakota Searchlight:

The Iowa Supreme Court Attorney Disciplinary Board ruled last month that Brian Jorde, an attorney who has represented hundreds of property owners in lawsuits against pipelines in multiple states — including South Dakota and Iowa — submitted “misleading or deceptive” information during both states’ utilities commission proceedings regarding permit applications for the carbon sequestration project.

Jorde’s filings on behalf of Dugan, however, included introductory written testimony, which Dugan later said, in an email to Jorde obtained by the advisory board, were “not statements I would choose to submit.”

The reprimand said Dugan did not approve these written statements. The statement submitted in South Dakota had an electronic signature at the bottom, but the IUC document had not been signed by Dugan.

The board concluded the actions in South Dakota were “deceptive” and wrote it was “deeply concerning” that Jorde and his staff did not mention to Dugan the extra pages filed in addition to the research she had consented to filing.

  1. This is happening in real time on Mark Lapka’s Facebook page. He and Randke are getting folks fired up on Dusty Johnson’s latest HR as it pertains to Carbon pipelines. It does nothing to fast track CO2 pipelines. Most reasonable people who can read legislation understand that. It does nothing to circumvent HB1052 eminent domain law. They see the word “carbon” or “sequestration” and automatically spin to land owner rights when it has nothing to do with it. It confuses people, especially those who are trustworthy of our elected official.

      1. I generally think Mark is a trustworthy legislature but am getting tired of his politics. Why can’t he pick up the phone and call Dusty’s office or try and schedule a meeting to deconflict information. Elected official to elected official. His Facebook post looks like it was written by a lobbyist (Radke) rather than an elected official. But I guess when you are bucking for Hansen you will toss out any info to try and trash a fellow gubernatorial candidate. I am an independent and on the fence right now but will more than likely register Republican to jump in the primary. I’m sitting back and watching now.

        1. Brian Jorde’s pawn. Anything to keep it all going. He’s the only one getting rich off of this deal and he can’t make more cash if it all ends.

  2. Really? Deceptive? Lying is all they have done. Lapka is at the top of the list. All passion, no thought on the pipeline issue. Why would he call Dusty’s office directly and risk getting facts and losing plausible deniability.

  3. Amazing how an environmental lawyer had such a huge influence over people who claim to be conservative.

  4. Lie and misinformation is all he and the anti pipeline followers knew how to do! Hopefully this goes farther so finally the residents of South Dakota will understand that we lost a golden opportunity to support agriculture and economy development right here.

    1. Ranchers won’t say it but they want the ethanol industry to fail at all costs. Ethanol expansion = higher corn prices = higher feed costs for cattle.

  5. Ranchers want high prices for their calves. The ethanol industry has revolutionized the cattle feeding industry in South Dakota with distillers grains. Ranchers should be the most excited about a robust ethanol industry!
