Attorney General Jackley Joins Amicus Brief Requesting U.S. Supreme Court Uphold Stay on Mifepristone Requirements

PIERRE, S.D. – South Dakota Attorney General Marty Jackley announces he has joined 22 other Attorneys General in filing an amicus brief requesting the U.S. Supreme Court uphold a lower court’s stay of a federal regulation that removed the longstanding in-person dispensing requirement for the chemical abortion drug mifepristone.

The brief supports the state of Louisiana, which is suing the federal Food and Drug Administration for a 2023 rule that removed the in-person dispensing requirement. That allowed the drug to be shipped across state lines.

“South Dakota lawmakers and citizens have said repeatedly they want stronger rules for the distribution of this drug,” said Attorney General Jackley. “The states, not the federal government, should make their own decisions on this dangerous drug.”

Nebraska filed the brief. Other states involved were Alabama, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Mississippi, Missouri, Montana, North Dakota, Ohio, Oklahoma, South Carolina, Tennessee, Texas, Utah, West Virginia, and Wyoming.

  1. Inflation is up. Energy prices are up. Gas is up. Food is up. Unemployment is rising. Economy is getting set to tank.

    And these guys are still concentrating on controlling women. Are we winning yet?

  2. Marty Jackley — controlling your life in your bedroom, your bathroom, your doctor’s offices, and your pharmacy — all the while claiming to be a champion of freedom.
    Plenty of men like to dominate and control women, so I understand why they support Marty. But I’ll never understand why any woman would EVER support him. Sad!

    1. He’s ridiculous. He just jumps on all the MAGA bandwagon stuff without really evaluating whether it’s a good use of our tax dollars.

    Have we? Lawmakers maybe but I don’t recall having any input as a citizen.

  4. Pregnant girls and women will get an abortion any way they can. If they can’t receive the pills via mail, that’s just going to cause more second term abortions. The wait to get into a clinic is very long. By the time they get an appointment, they’ll be in the second trimester. Congrats, GOP.

  5. Lots of unfortunate flag waving. The Justices of the U.S. Supreme Court will do whatever they want to do without a second thought as to how South Dakota thinks or feels. Arguably, the civil division of the AG’s office ought to be getting their pencils ready to write a brief that puts the legal kibosh on Trump’s attempt to cease the collection of federal taxes on fuel. This 94 year old tax has paved thousands and thousands of miles of South Dakota’s roads, and paid for the construction of almost every bridge in the state. Let’s be honest with ourselves for a moment, Donald Trump started the war in Iran (to the present tune of $29 billion according to the DOD), gas prices then went up, and creating an $11 billion dollar deficit in our nation’s road and bridge funds in order to alleviate the pain at the pump is a pretty dumb plan…a cheap, and near-sighted plan. For that matter, the actual federal fuel tax hasn’t seen an increase since 1993, but every year those funds are doled back out to the states, who in turn dole them out for roadwork and infrastructure repair and replacement. So, if I were AG Jackley, I would stop waving the flag for the pro-life group, and get ready to bring the heat against Trump’s plan to destroy our state’s roadways and bridges.

  6. The hypocrisy of this party is intense. You can’t make us wear masks but we’ll tell you what you can and can’t put in your body.
