More legislation from today. Taking a break from quickly cribbing the Governor’s idea to protect church services from disruption, today Representative Brandei Schaefbauer is back with more legislation.
It should not come as a shock, as Brandei promised something to the effect of bringing last years’ failed legislation back when she took to social media to promote goofiness & conspiracy theories back in July:
I would also guess that she’ll bring ShadGPT back to committee and to write her talking points. I hate to say it, but so far this year to date I’m not seeing any legislation that’s actually coming from her constituents. Just someone who has been seen with her as a traveling companion, and a trendy topic she appears to be trying to use to get a leg up on the Governor with.
Someone should do something about District 3 Representatives bringing back legislators who actually bring bills for constituents. (Like supporting Spencer Sommers for House, and Katie Washnok for Senate.)
We’ll see if Brandei’s re-run COVID conspiracy resolution gets past the House this year. We can only hope that neither taxpayers nor the Attorney General’s office have to waste anymore time than is required to defeat it.

I wonder if Rep. Schaefbauer will bring her buddy who testified for her COVID resolution last year back to committee again to testify why we need to sue China?

Honest question, if this were to pass, would the attorney generals office be obligated to file a lawsuit? Foreign affairs are exclusively a federal matter. There’s this little thing called the supremacy clause in the Constitution. Brandie might want to look at 28 USC 1602-1611. Every attorney, even the AG, is bound by the rules of ethics and cannot file frivolous lawsuits. Which this would be. Let’s say the lawsuit is filed, service is made by publication (unless we can figure out a way to make personal service happen), China ignores it, we get a default judgement. How does Brandei plan on forcing China to pay? Does SD have the power to seize foreign assets? (Hint: no).
She wants to force the AGs office to violate the rules of professional conduct to file a frivolous lawsuit that would be impossible to collect on even if we win. All on the taxpayers dime. This is the exact kind of ineffective legislator that our state needs to get rid of in June.
As someone who totes being “a protector of the Constitution,” someone who bases their entire life principles on the Constitution, and a freedom fighter who will battle to the end to defend the Constitution… I don’t think Brandei has ever actually read the Constitution. So she wouldn’t know.

District 3, your representation in Pierre is an absolute laughingstock. Please, for the love of God, get to the polls on June 2 and send us a clean slate; all three need to go!

Bwhahahaha! Shad’s post caught me completely off guard. I literally spit coffee out, staining my shirt and ruining a document I was reviewing. That level of crazy is equal parts hilarious and terrifying.

I posted some calls for moderation and decency last month when everyone was making fun of Shad’s huge legal problems. I now greatly regret having called for that show of decency. It is clearly not warranted.
