This week was a big one for court losses from the edge of politics, as a lawsuit asking for a writ of prohibition against Governor Kristi Noem, seeking to deny her the ability to spend funds to improve rural broadband, was shot down by the state supreme court:

This comes after an official AG’s opinion where14 legislators, led by Rep. Taffy Howard tried to ask the AG to stop the expenditure.   1. Ok crybaby haters, sure looks like the AG comes out smelling like roses and yes that is Fitzgerald’s son, who apparently passed the bar, [redacted], but apparently has some things to learn. Oh did I mention the AG won again?

    (I don’t know that there’s any public evidence of what I redacted, and it goes beyond opinion, so I’m going to make the call – PP)

  2. A job, what an idiotic reply. He is supposedly an attorney, since as all you legal scholar bloggers have an incredible grasp of the law, the kid should have known this was the obvious outcome and told his clients to save their money instead of charging them for a loser case that took about 15 seconds for the chief to dismiss.

  3. Fitzgerald chose to take this case and lost. No one forced him to take it.

    He chose to sue to stop rural broadband.

    He chose to sue to stop the governors priorities.

    Then he essentially copied the LRC memo…I have never seen an attorney acknowledge someone else’s work in a complaint. Notice that?
