Soye nanny state anti-porn measure dropped in favor of study to find restrictions that pass constitutional muster

House bill 1257, the anti-porn measure authored by State Representative Bethany Soye that went through the House, but found opposition in the State Senate as a result of questions over it’s constitutionality, has now become a summer study as South Dakota legislators seek a path forward that won’t trigger constitutionality lawsuits where taxpayers end up footing the bill:

“We should deal with the scourge of children’s access to pornography, but we should do it right and in a way that doesn’t pay checks to the ACLU,” Schoenbeck said earlier this week.

and..

But defenders of the original effort aren’t as confident a summer study will prove useful.

“I think the stakeholders on that bill have already done a lot of study on it, and this is what they came up with,” said Sen. Jim Mehlhaff, who sponsored the bill along with Soye.

I’m sure the sponsors of the measure did plenty of study on pornography, but as was also the case with Soye’s earlier legislation abridging free speech, it was another big government measure that would ultimately fall when challenged in court.

If Republicans claim to be for limited government when they’re campaigning, they need to walk the walk in Pierre as well. More government is rarely as much of a solution as it is a problem.

Thinking about the 2024 election? There’s time and opportunity to advertise on SDWC!

I want to thank The South Dakota Academy of Opthalmology and the South Dakota Optometric Society for their support and advertising while competing on House Bill 1099 during the legislative session. As the legislative session comes to a close, once again we find ourselves with advertising space on Dakotawarcollege available for groups and individuals to promote their messages to opinion leaders in South Dakota as we move into the the 2024 campaign season.

Interested in advertising? Have a ballot measure, cause, candidate or campaign related business? There are limited advertising opportunities left for reaching South Dakota’s opinion leaders. Advertising on the Dakotwarcollege.com website is based on a first come, first serve basis for available positions.  As of this writing, we have several spots open now, including the #2 and #3 spots on the right, along with spots on the left, including the #1 spot on the left which will open up shortly.  Monthly spots are available, and I do provide discounts for longer ad commitments.  Information on ad prices, ad positions, and ad commitments may be directed to the webmaster by clicking here.

Please take a moment to visit our advertisers such as the fine folks at Summit Carbon Solutions supporting the ethanol and biofuel industries in South Dakota. America’s Governor, and South Dakota’s chief executive Governor Kristi Noem, soon to be #1 in the US Senate and our friend South Dakota Senator John Thune, our undisputed and undefeated Congressman Dusty Johnson, and the equally undefeated Republican United States Senator Mike Rounds. Our friends at South Dakota Ag Alliance are also here to fight for landowner rights and common sense ag development.

Please also support SDGOP Chairman John Wiik and the South Dakota Republican Party’s leadership team, as they move into the election season. Chairman Wiik has a challenging job, and as we know all too well, it’s not an easy one to try to recruit candidates and win elections when you’re fighting those from without and those from within.  Of course, at Dakota Campaign Store, down on the right, you’ll find me already busy in 2024 with yard signs, postcards, and all the things a professional campaign needs to make an impression.

Thank you to our advertisers for your support, and please reach out if you’d like to join them!

Dear SDGOP Central Committee.. So are you going to un-ban me, or kick those guys off the island too?

Made note of something interesting today.  Recalling the “ban” by the Republican State Central Committee imposed on the State GOP from doing business with me or hiring me to help candidates as they have the last several elections, because some consider me a petulant blogger, etc, as a result of my pointing out stupid, or in their words making attacks on some Republican politicians..  this posting by the Butte County GOP today didn’t escape my attention:

So, what I do as a private citizen (not holding GOP position or office) and criticizing Republican officeholders is bad enough for them to declare a ban on me.  But as the Butte County Republican organization takes to social media and is attacking the House Majority Leader, the Senate Majority Leader, and two Senators, with several of them also serving on the State GOP Exec Board and/or the State GOP Central Committee.. is that now ok as it comes from inside the organization?

If that’s the case, does that mean they’re going admit they messed up and un-ban me? Or does it mean they have to be consistent, and hold a vote to ban the Butte County GOP as well?

What’s the saying? Ok for thee but not for me..

Just asking.

Today, Summit Carbon Solutions released the following statement in response to the passage of the Landowner Bill of Rights by the South Dakota State Legislature:

We look forward to doing our part to create and maintain successful relationships going forward. As South Dakota Ethanol Producers said, this legislation is unequivocally pro-landowner, pro-business, pro-farmer, and pro-ethanol. SDEPA Applauds Passing of Compromise Landowner Bill of Rights

PIERRE, S.D. (March 6, 2024) – The South Dakota Ethanol Producers Association applauds the South Dakota Legislature for passing a package of compromise bills that will provide the nation’s first Landowner Bill of Rights along with needed regulatory certainty for CO2 pipelines.

“Thank you to Leader Crabtree and Leader Mortenson for their steadfast determination to make sure this was a good deal for landowners and for businesses looking to create long-lasting economic development in this state. We applaud the South Dakota legislators who supported farmers, landowners, and ethanol with this compromise,” said Walt Wendland, SD Ethanol Producers Association Board President. “This legislation is pro-landowner, pro-business, pro-farmer, and pro-ethanol. It’s a win-win for all South Dakotans.”

Leveraging carbon capture in South Dakota to further decarbonize ethanol provides new market opportunities and adds value to every bushel of corn and every acre of land.

“I believe both of these nominees have the character and impartiality to serve lifetime appointments on the federal bench.”

Republican Christopher Sanders files paperwork for Congress, launches cringeworthy website

It must be the day for candidates who won’t get on the ballot.  First, Democrat Sheryl Johnson launched a campaign in Sioux Falls running for Congress from the hard left. And now this afternoon comes a new Republican in the congressional race from.. well, it seems like outer space once you start digging into it.

A Christopher Sanders from out west has filed paperwork to run for Congress, joining Justin McNeal and Patrick Schubert among the peanut gallery of candidates who have declared that they want to challenge incumbent Congressman Johnson in the Republican Primary:

Sanders FEC Filings by Pat Powers on Scribd

This candidacy comes even farther out of the blue than the Democrat challenger’s announcement did today with the filing of the “Sanders for South Dakota” committee paperwork with the Federal Elections Commission.  I had never heard of this Christopher Sanders character, but in doing a web search, there is a website out there apparently that he has set up for the campaign:

On the campaign website, Sanders claims endorsements from several figures, including noting the poker playing crop insurance agent & major Taffy Howard donor Luke Blindert as his “Sioux Falls Campaign Coordinator.”

Of course, he also claims the endorsement of some guy as his MAGA Fashion designer and quotes him as saying that he “will help Chris win for the State of South Dakota just like I helped Congresswoman Lauren Boebert in Colorado, through style and fashion.”  Not sure I know a lot of Congressional candidates in the state who use a MAGA fashion designer. Maybe this is a new thing?  I especially noted the endorsement of Frank Dux, a man who was portrayed by Jean Claude Van Damme in the movie Bloodsport.

The campaign notes that it has offices located at 500 East Blvd in Rapid City in Suite 1402. Which must be staffed by very tiny people, since that’s the address of the post office, and 1402 would be a PO Box.  If you dig further into his website, Sanders also claims “Together he has a published a book called “The Convenient Solution” and “Sustainable Freedom” where he introduced Elon Musk to the world some 20 years ago.

You know, it’s a free country and all, but this is some seriously off-the-wall stuff, which we would not have discovered if he hadn’t filed FEC paperwork.

Maybe it’s just me, but I have the sneaking suspicion that this might be another new candidate who won’t get on the ballot.

Stay tuned.

Lawrence County facing dilemma of initiated measure petition filed that potentially violates federal law

The Black Hills Pioneer has a story on their website today on how Lawrence County, and potentially up to 26 counties are facing a headache of initiated measures at the county level that experienced election lawyer Sara Frankenstein believes stand in direct violation of federal law, and will give cause of action for the ACLU and others to bring suit against Lawrence county and other counties who would if the initiated measure would pass in this or other counties:

She said South Dakota Canvassing does not seem to understand why the machine exists as required by the Help America Vote Act.

These specific machines are designed to help people with disabilities vote independently.

and..

“Who in the world would be against that,” Frankenstein asked. “Who would be against helping disabled people vote? I don’t think these folks realize that when they put number three on a petition, that says electronic voting devices of any kind are prohibited.”

She said the Help America Vote Act requires one of those electronic devices to be in every polling place for every federal election. “So, if your ballot has a federal election on it, those have to be in the polling place,” she said. “So, the problem with the petition, there could be others, but the one that’s just glaring and obvious for this election lawyer is that number three, there’s no exception made for federal cases … so it outright violates the Help America Vote Act.”

and..

Frankenstein said if that happens, the county will be sued. She said she will get called to defend the county, and she will lose.

“I can’t possibly defend that,” she said. “How could I defend a county ordinance that violates federal statute?”

That’s the problem with the election conspiracists who insist we need to be using paper ballots. Why should they be concerned about things like federal laws and civil rights getting in the way of their zealotry?  Just because it could cost county taxpayers millions in lawsuits doesn’t matter in their pursuit of internet conspiracies.
